So you’ve fallen in love with one of our properties? Great! Now it’s time to give our team a call to discuss making a suitable offer. When making an offer, our team will likely ask you to provide “evidence of funds”, which demonstrates that you have the means available to substantiate your offer amount. This will normally include evidence of your deposit funds, together with your official Mortgage Agreement in Principle (AIP). If you haven’t got your AIP in place just yet, don’t panic, we have a helpful mortgage advisor who can assist you with your financial needs if required. If you are purchasing from the proceeds of a property sale, then our team will speak to your chosen selling agent to verify the chain information.
At this point we will ask you to confirm your conveyancer/solicitor details so that we can issue the “Memorandum of Sale”. This is a formal document confirming details of the property sale to each respective legal party, who will then contact each other to commence the legal process. Purchaser’s at this stage would normally provide fees on account to their legal representative in order to raise Search Enquiries with the Local Authority.
Once the memorandum of sale has been issued, we recommend that purchasers submit their formal mortgage application, and arrange any Building Surveys to be undertaken. Again, our team have reputable contacts available for both mortgage and surveying needs if required.
Whilst arranging your mortgage/survey needs, your conveyancer will have lodged Search Enquiries, and will be beginning to raise enquiries for the Sellers conveyancer to answer. These are general enquiries concerning the property title and information, so that they are able to provide you with an informed report, so that you are clear about your rights and responsibilities as the future homeowner.
So you have received your mortgage offer, your conveyancer has received searches and replies to enquiries, now what? At this stage, your conveyancer will begin to prepare a “Report on Title”, which is a formal report explaining the ins and outs of the Freehold or Leasehold property that you are purchasing. Once you have read and understand the report, your conveyancer will issue you with a legal contract to sign and return, in readiness to exchange contracts.
Once you have returned your signed contract, your conveyancer will request your deposit monies in readiness to exchange. Once you have paid your deposit, your conveyancer will request your authority to exchange, and at this point a formal completion date shall be agreed by all parties. Upon exchanging contracts with the sellers solicitor, you are legally bound to purchase the property, and the seller is legally bound to sell to you.
This is the date that the the sale/purchase will formally complete! Your conveyancer will send the purchase funds to the sellers solicitor, and upon receipt, you are the new legal owner and free to come to our office and collect keys to your lovely new home! Congratulations!
If you are looking to purchase a property, ensure that you have your finances in place prior to making a formal offer. This includes having a readily available deposit, or ensuring that your current home is in a sold STC position. This ensures that you are a “proceedable buyer” at the point of offer.
